1. Acceptance of Terms

By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

We provide a mockup generation service that allows users to create and export visual mockups. The service includes:

Ability to purchase credits for exports
Local image processing in your browser
Access to our template library and animations

3. Credits and Payments

3.1 Payment Processing and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

All payments are processed securely through Paddle. By making a purchase, you agree to Paddle's terms and conditions. Paddle accepts various payment methods including credit cards and other payment options available in your region.

3.2 Credit System

Each export requires one credit
Credits are non-transferable
Credits do not expire unless the service is terminated

3.3 Subscriptions

We offer monthly subscription plans that provide unlimited exports:

Subscriptions are billed monthly and renew automatically
You can cancel your subscription at any time through your account settings or by accessing the Paddle Customer Portal
When you cancel, your subscription will remain active until the end of the current billing period
No refunds are provided for partial subscription periods after cancellation
If you cancel, you will lose access to unlimited exports at the end of your billing period
Subscriptions automatically renew unless canceled before the renewal date

3.4 Refund Policy

We offer refunds under the following conditions:

Technical issues preventing service usage
Unsatisfactory results within 14 days of purchase
Unused credits within 14 days of purchase

For unsatisfactory results:

You may send proof of the unsatisfactory results to info.promogen@gmail.com
We will review your case and either:
- Add new credits to your account, or
- Process a full refund if the issue cannot be resolved

Refunds may not be provided for:

Used credits (credits must be unused to qualify for a refund)
Credits purchased more than 14 days ago
Service termination (as per section 8)

4. User Content and Rights

4.1 User Content

You retain all rights to the content you create using our service. We do not claim ownership of your exported mockups.

4.2 Service Assets

While you own your created content, you may not:

Resell or redistribute our template files or animations
Reverse engineer our service or assets
Use our service to create content that infringes on others' rights

5. Account Management

5.1 Eligibility

You must be at least 16 years old to use our service.

5.2 Account Responsibilities

Maintain accurate account information
Keep your account credentials secure
Notify us of any unauthorized access

5.3 Account Termination

We reserve the right to suspend or terminate accounts that:

Violate these terms
Engage in fraudulent activity
Remain inactive for 12 months

6. Service Availability

While we strive to maintain continuous service availability, we do not guarantee uninterrupted access. We will:

Make reasonable efforts to maintain service uptime
Provide notice of planned maintenance when possible
Work to resolve any service interruptions promptly

7. Intellectual Property

Our service, including templates, animations, and website design, is protected by intellectual property laws. You may not:

Copy or modify our service or assets
Use our service for any illegal purposes
Attempt to access our service through unauthorized means

8. Service Termination

In the event of service termination:

We will provide at least 30 days' notice
Unused credits will not be refundable
You will have the opportunity to export your content

9. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for any indirect, incidental, or consequential damages
Our total liability is limited to the amount you paid for credits in the last 12 months
We are not responsible for any loss of data or content

10. Changes to Terms

We may modify these terms at any time. We will notify you of significant changes via email or website notice. Continued use of the service after changes constitutes acceptance of the new terms.
